Abstract

In the article the author analyzes the concept of adaptation of agrarian legislation to the legislation of the European Union. The main normative legal acts of the European Union, which are the sources of the acquis communautaire, are examined. The main directions of future adaptation of the agrarian legislation of Ukraine to the legislation of the European Union are highlighted.

Adaptation of the agrarian legislation to the legislation of the European Union is determined by the author as a litigation of approximation (adaptation) of regulations governing agricultural relations in Ukraine to the legal system of the European Union, which includes acts of the European Union legislation adopted within the European Community, the Common Foreign and Security Policy and Cooperation in the field of justice and internal affairs, with an aim to promote the development of agriculture and rural areas.

The main directions of adaptation of the agrarian legislation of Ukraine to the requirements of the acquis communautaire are determined by the Association Agreement between Ukraine, on the one side, and the European Union, the European Atomic Energy Community and their Member States, on the other side, ratified by the Law of Ukraine dated September 16, 2014, the Agreement of agriculture, which is Annex 1A to the Agreement on the establishment of the World Trade Organization dated April 15, 1994 and other regulations of Ukraine and the EU. The author identifies the following main areas of adaptation of the domestic agricultural legislation to the EU legislation: 1) approximation of legislation on methods of agricultural production; 2) adaptation of legislation with the organization of the agricultural market and trade in plant growing and animal husbandry products; 3) approximation of legislation on requirements for the quality of agricultural products; 4) improvement of legislation on environmental protection in the process of agricultural production and development of organic production; 5) approximation of legislation on the development of rural areas and rural communities; 6) ensuring sustainable agricultural production; 7) adaptation of legislation on state support of agriculture.
